AdVenture Group Internet Service Agreement

This agreement is between AdVenture Graphics / Adventure Group and Customer (as stated on the Web Hosting Registration Form).

Definitions: AdVenture Group consists of software, information, and network services (the "Service") provided by AdVenture Group("ADVNG"). Third party software, information, and network services ("Third Party Services") are also accessible through ADVNG. Use of the Service constitutes acceptance of this agreement.

No Warranty: The Service is provided as is. ADVNG makes no warranties, whether written, oral or implied, including without limitation, warranty of fitness for purpose of merchantability with respect to the Service or to Third Party Services.

Payment: Customer agrees to pay ADVNG for the Service in accordance with the current rate schedule (Exhibit A) attached hereto and as may from time to time be amended. Invoices will not be sent to Customer . It is the responsibility of the Customer to mail their payment in on time. Minimum quarterly charges are payable in advance. No other payment notice will be sent. Statements not discharged within 20 days will be charged 8% interest per month and the Customer will be denied access to the Service until statement is discharged.

Liability: In no event shall ADVNG be liable for special or consequential damages, either in contract or tort, whether or not the possibility of such damages has been disclosed to ADVNG in advance or could have been reasonably foreseen by ADVNG. The parties agree that all liability to Customer shall be limited to an amount equal to payments made to ADVNG during the period under dispute as liquidated damages and ADVNG shall be relieved of further liability under this agreement.

Customer Liability: Customer is liable for any damages that result from willful or negligent violation of this agreement, the acceptable use policy of ADVNG, or the acceptable use policy of an any Third Party Services.

Changes: This Agreement and the rate schedule may be modified by ADVNG by a specific 30 day notice published on the Service.

Acceptable Use: In the event of inappropriate use of the Service or of Third Party Services, ADVNG, at its sole discretion, may terminate this agreement or suspend Customer access to the Service Customer will be notified in writing of this action. Customer agrees to abide by acceptable use policies for the Service as published on the Service.

Privacy: In the course of monitoring individuals improperly using the Service, or in the course of system maintenance, the activities of authorized customers may also be monitored. ADVNG may, at its sole discretion, cancel, edit, or remove information that is made publicly available by Customer.

Files: ADVNG makes no claims regarding availability of Customer files stored by the Service. Customer is responsible for making appropriate backups of such files.

Service Changes: ADVNG may change the Service without notice including, but not limited to, the availability of software, access to Third Party Services, organization of information, acceptable use policies, and other aspects of the Service.

Age: Individual Customers must be at least 18 years of age or this agreement must be signed by a parent or legal guardian. ADVNG is not responsible for monitoring or restricting Customer access to the Service

Applicable Law: This agreement shall be governed by the laws of the State of Pennsylvania. Any cause of action of the Customer or a designated user with respect to this contract must be instituted pursuant to paragraph 13 within one year after the claim or cause of action has arisen or be barred.

Disputes: Any disputes that arise between the parties with respect to the performance of this contract shall be submitted to a Court of competent jurisdiction in Lackawanna, PA, and shall be determined and resolved by said association under its rules and procedures in effect at the time of submission. The parties hereby agree to arbitration as the first method of dispute resoloution and share equally all costs of said arbitration.

Non-enforcement: Non-enforcement of any section of this Agreement does not constitute consent and the Service reserves the right to enforce this agreement at its sole discretion.

Severability: If one or more paragraphs in this agreement is found to be unenforceable or invalid, the Customer and ADVNG's agreement on all other paragraphs shall remain valid.

Notices: All notices given by any party or required under this agreement shall be in writing and addressed to the relevant part(y) (ies) at the following location:

Termination: This agreement may be terminated by either party on 10 days written notice. The Customer agrees to pay all outstanding service fees at the time of termination.

Assignment: This agreement may not be assigned by either party without the prior written consent of the other party. Except for the prohibition on assignment contained in the preceding sentence, this Agreement shall be binding upon and inure to the benefit of the heirs, successors and assigns of the parties hereto.

Exhibit A: Rate Schedule

Billing: The Customer will be billed for this account once a quarter with the first use of the account signifying the starting date of the billing cycle. The bill will be for the following Quarter and for any additional time used in the previous quarter.

Web Hosting: The rate for Web site hosting will be $50 to activate a virtual domain account or $25 to activate a AdVenture Group hosted account, and $86.85 per billing period (quarter) (28.95 p/month) thereafter. The first payment must be received before the account is activated. The first payment includes the setup fee and the first month’s rental charge. Web site hosting service includes a virtual host with 300MB of disk space, 10GB of data transfer per month,  POP3 e-mail account, and FTP access. This account will allow you to administer your site with Microsoft FrontPage or HTML. 

InterNIC domain registration fees are the responsibility of the Customer. SSL and S-HTTP can be provided if requested. The Customer is responsible for purchasing the appropriate encryption key.

Additional Services: Additional services as ordered by the customer will be billed at the currently advertised rate for the Service. This includes, but is not limited to programming, additional e-mail accounts, additional disk space, additional data transfer, and design services.

Additional Charges: The customer is responsible for any additional charges incurred in accessing the Service, including but not limited to, long-distance telephone charges for connecting to the Service.

Web Hosting Registration Form

Web Hosting (with or without virtual host) includes 300MB disk space, 10GB data transfer/month,  5 POP3 e-mail account, and FTP access to your Web site. This account will allow you to administer your site with Microsoft FrontPage or html.

There are two options for hosting. Virtual Host, and Pa4u Internet hosted. Virtual host allows you to have your own domain (ie. www.yourwebsitename.com). Pa4u Internet hosting provides access to your Web site through the Pa4u Internet domain (ie.www.pa4u.com/yourwebsitename).

AdVenture Group Costs Schedule:
